What is co-employment?

An arrangement where two companies both have rights and obligations as an employer.

The business maintains responsibilities for the worker’s job duties and day-to-day functions while the co-employer manages personnel-related functions such as payroll. In this way, the worker is technically employed both by the business and the co-employer.

In the world of independent contracting, co-employment commonly occurs when staffing agencies engage independent contractors for their clients. While the business is primarily responsible for HR functions such as recruiting, hiring, and payroll, the company handles the work agreement. In this situation, because the staffing agency and the client have obligations to the contractor, they can both be viewed as an employer.

Co-Employment will be particularly beneficial for the following sectors:

How does it work?

Co-employment is a contractual agreement between a company and a Professional Employer Organisation (PEO).

The Company and the PEO allocate and divide employer responsibilities between them. In a co-employment agreement, your company’s employees (also called worksite employees) are employed by two separate entities:

  • The client company (Agency/end client/labour user)
  • The PEO (Conmissura)

The PEO supplies services and benefits to a business and its existing workforce (PEOs don’t supply a workforce).

The business owner maintains control of:

  • All business decisions
  • All business operations
  • All employees’ daily duties and core job functions
  • Agreeing/negotiating offered Pay Rates

The PEO is typically responsible for:

  • Processing payroll and administering payroll deductions
  • Issuing payslips, contracts and other documents
  • Preparing, filing and depositing payroll taxes
  • Providing benefits to worksite employees
  • Providing HR advice to the client company
  • Providing employee references

As the plan sponsor, the PEO assumes all plan sponsor responsibilities and obligations from start to finish.
